Home Education Center Who's Looking Out for You?

Will the Corbett Administration?

Does the new Impact Fee legislation do enough?

NOT the EPA

EPA rules don't apply to water from private wells

NOT
the PA Department of Environmental Protection

Protecting and maintaining a private well is the responsibility of the homeowner

NOT
the Safe Drinking Water Act

The "Halliburton Loophole" exempts fracking from federal regulation

NOT
the Gas Companies

They're protecting themselves, not you. Why?

The law presumes they are GUILTY of the contamination UNLESS:

  • The pollution was already there (so they test to be sure)
  • You turn them away when they come to test (please let them in)
  • Your well is outside 2,500 feet (only within a small radius)
  • The pollution occurs 12 months after drilling stops (don't wait too long to make a claim)
  • Something else caused the pollution (It wasn't us...)

But the law does not require the driller to:

  • Test your water before drilling (though they have a huge incentive to do it)
  • Test for any particular contaminants (their test might not cover contaminants you should test for)
  • Test your water after drilling (there is NO INCENTIVE TO TEST AFTER DRILLING)

Get your own baseline test... from an independent source... that doesn't work for any gas companies

Could these small fines have any impact?
